Further to the FOI request 3870500, with particular reference to the responses to Q3c and 4 it would appear that Rushcliffe Borough Council hold over £10,032,000 of unspent S106 contributions that relate to obligations that are over 5 years old. 

Please could you provide the following details for all S106 Agreements that are over 5 years old (any agreement dated 31 March 2021 or earlier) where required and collected S106 contributions remain unspent.

• Planning Application reference number
• The relevant planning obligation contribution collected and the level of S106 contribution that remains unspent 

Response

The attached table includes details of all S106 contributions which were received in the 2020/21 financial year or earlier, where all or part of that contribution remains unspent. Note that the total retained figure differs from the £10,113,584.90 reported in your initial request; this is due to spend of some contributions in the intervening period as well as the accrual of further interest against retained contributions.

For the avoidance of doubt, the "relevant planning obligation contribution collected" to be the opening balance recorded against each contribution at the start of the 2021/22 financial year, and the the level of S106 contribution that remains unspent is the retained balance at the close of the 2025/26 financial year, less any additional amount received where a financial contribution was payable in multiple tranches. Where balances have increased, this is due to the accrual of interest against the relevant contribution. Each contribution has also been broken down by category.
