In relation to the Bingham Gate development in Bingham.

I would like to request copies of any documents relating to construction traffic management for this development, including but not limited to:

  • Construction Management Plan (CMP)  
  • Construction Traffic Management Plan (CTMP)  
  • Any planning conditions relating to construction traffic, routing, parking, or vehicle movements  
  • Any agreements, guidance, or correspondence relating to the use of surrounding residential roads by construction vehicles  
  • Any enforcement or monitoring records relating to construction traffic at this site

Review

The response is not adequate and does not properly answer the request made. I requested the relevant traffic management/construction traffic planning documents relating to the Taylor Wimpey Bingham Gate development in Bingham.

In response, I was directed to the Planning Online portal and given planning reference 23/02038/DISCON, with no direct copy of the requested document(s), no explanation of which specific document I am expected to review, and no confirmation that this reference relates to the Taylor Wimpey Bingham Gate development that is the subject of my request.

Having reviewed the reference provided, it appears this may relate to a different development and in any event the response does not identify the specific document(s) relevant to my request. This response is not sufficient. Directing a member of the public to a large planning portal and requiring them to locate and interpret technical planning documents themselves is not a reasonable discharge of the request, particularly where:

  • the specific document requested has not been identified,
  • no direct copy or link has been provided,
  • the planning reference supplied may be incorrect.

Response

The result of our review is as follows:

The Taylor Wimpey Bingham Gate development in Bingham was approved by virtue of outline planning permission (ref. 17/01170/VAR) and reserved matters approval (ref. 20/03212.REM). The specific traffic/construction management document(s) were required to be submitted by virtue of condition 16 on the outline permission. Application ref. 21/02807/DISCON sought to discharge condition 16 for the part of the Bingham development upon which the Taylor Wimpey Homes are being built. Please accept our apologies, the incorrect reference was provided previously.

The relevant documents are as follows: Condition 16: Construction Method Statement: Drawing number H7703/30MP Rev dated 10.06.2021 titled “Construction Management Master Plan, Bingham Phase 2”, and the details within the covering email from Mr B. Douglas re Pilling dated 22 November 2022 available to view on our portal by searching for the reference number 21/02807/DISCON - 21/02807/DISCON | Discharge of Conditions 6 (Sustainable Drainage), 7 (Employment and Skills Plan), 8 (Ecology Habitat Management Plan), 9 (Open Space Plan), 13 (Highway Delivery plan), 16 (Construction Management Plan), 20 (Landscaping Plan), 21 (Arboricultural Method Statement) from planning permission 17/01170/VAR | Land West Of Chapel Lane Bingham Nottinghamshire.
