Please see my FOI request below. I would like the following information regarding requests received from residential developers to vary existing Section 106 agreements by way of a Deed of Variation in relation to affordable housing, broken down between:

• 1 February 2024 to 31 January 2025
• 1 February 2025 to 31 January 2026
• 1 February 2026 to the date of this request

For each period, please provide:

1. The total number of requests received from residential developers to vary existing Section 106 agreements in relation to affordable housing.
2. Of those requests, the number that resulted in a Deed of Variation being agreed/completed.
3. Of those requests, the number that were refused or otherwise rejected by the authority.
4. Of those requests, the number of requests that remain outstanding or under consideration.
5. For each request that was refused or rejected, the recorded reason or reasons for that decision (if recorded).

I have attached a spreadsheet where the responses can be inputted, if helpful.

Response

The Council does not collate or record requests for variations of legal agreements, only where this proceeds to a variation being agreed and signed do we maintain a record. As such I can confirm that we do not hold records relating to your questions 1, 3, 4 and 5.

In respect of question 2, we agreed 2 deeds of variation during the periods details, both were signed during 2025 and both related to affordable housing matters.
