Please provide the following information in relation to any housing development by Bloor Homes Limited (including subsidiaries) granted planning permission within your authority's area since 1 January 2015:

  1. Condition Discharge Records
    1. A list of all planning conditions relating to ecology, biodiversity, habitat creation, tree planting, hedgerow retention, or species protection (including but not limited to bird boxes, bat boxes, hedgehog highways, reptile refugia, wildflower grassland, and woodland planting) attached to any Bloor Homes planning permission.
    2. For each such condition: the date the condition was required to be discharged; the date (if any) on which it was formally discharged by the authority; and whether any non-compliance was identified prior to discharge.
  2. Section 106 Obligations — Ecology and Biodiversity
    1. Copies of, or details of, any Section 106 obligations entered into with Bloor Homes relating to: ecological mitigation; biodiversity net gain; habitat management plans; green infrastructure; SANG (Suitable Alternative Natural Greenspace) provision; or Species Management Plans.
    2. Details of any monitoring visits carried out by officers to verify delivery of ecological obligations at Bloor Homes sites.
    3. Details of any failure to comply with such obligations that was identified, and any action taken by the authority in response.
  3. Enforcement Records
    1. Details of any Planning Contravention Notices, Enforcement Notices, Breach of Condition Notices, or Stop Notices issued to Bloor Homes in relation to ecological or biodiversity conditions at any development within your area since 2015.
    2. Details of any informal warnings or correspondence with Bloor Homes regarding potential breaches of ecological or biodiversity planning conditions.
  4. Infrastructure Funding Statements
    1. Details of any biodiversity or ecological S106 contributions received from Bloor Homes that remain unspent, or were received late.

Response

There has been a total of 5 planning permissions since 2015 either granted to Bloor Homes Limited or where they were granted to a landowner before a developer had been appointed and Bloor Homes Limited have subsequently submitted more recent applications. Details of those are as follows.

  1. Condition Discharge Records
    1. A list of all planning conditions relating to ecology, biodiversity, habitat creation, tree planting, hedgerow retention, or species protection (including but not limited to bird boxes, bat boxes, hedgehog highways, reptile refugia, wildflower grassland, and woodland planting) attached to any Bloor Homes planning permission.

      • This information is not held
    3. Details of any failure to comply with such obligations that was identified, and any action taken by the authority in response.
      • In relation to to enforcement, Section 30 of the Freedom of Information Act 2000 sets out that information is exempt from release under the act if it falls under section 30(2)a(iii), which states as follows:
        • 30 (2) Information held by a public authority is exempt information if—

          (a) it was obtained or recorded by the authority for the purposes of its functions relating

          (iii) investigations (other than investigations falling within subsection (1)(a) or (b)) which are conducted by the authority for any of the purposes specified in section 31(2) and either by virtue of Her Majesty’s prerogative or by virtue of powers conferred by or under any enactment,

          In respect of the reference to ‘purposes specified in Section 31(2), in this case the specific clauses is 31(2)c:

          C) the purpose of ascertaining whether circumstances which would justify regulatory action in pursuance of any enactment exist or may arise,

          In this case the regulatory action into which the council would be investigating would be action relating to a potential breach of planning obligations.

          In addition, Section 30(3) states:

          (3)The duty to confirm or deny does not arise in relation to information which is (or if it were held by the public authority would be) exempt information by virtue of subsection (1) or (2).

          As such, in relation to enforcement, the Council would not be required to provide this information requested if it were held by us, but in addition we are also not required to confirm that we do hold any such information.

  3. Enforcement Records
    1. Details of any Planning Contravention Notices, Enforcement Notices, Breach of Condition Notices, or Stop Notices issued to Bloor Homes in relation to ecological or biodiversity conditions at any development within your area since 2015.
      • Enforcement notices, Stop notices, Breach of condition notices, all of these types of notices are published and searchable on our website as detailed above and using the Enforcement Search field.

        Planning Contravention Notices do not feature on published enforcement registers and by their nature represent information gathered and produced in connection with regulatory enforcement. Therefore, the response to this is the same as 2. e)

    2. Details of any informal warnings or correspondence with Bloor Homes regarding potential breaches of ecological or biodiversity planning conditions.
      • This would equate to information gathered and produced in connection with regulatory enforcement. Therefore, the response to this is the same as 2. e)
