Please provide a list of all vehicles that are licensed by the council as at the date this request is processed, including both:

• Hackney Carriage vehicles; and
• Private Hire Vehicles (PHVs).

For each currently licensed vehicle, please provide the following information:

1. Vehicle registration mark (VRM) / registration number.
2. Vehicle make.
3. Vehicle model.
4. Licence type (Hackney Carriage or Private Hire Vehicle).
5. Licence commencement date (valid from).
6. Licence expiry date (valid to).

As such this information is exempt under section 21 of FOIA because it is reasonably accessible to you and the terms of the exemption mean that we do not have to consider whether or not it would be in the public interest for you to have the information.

I am writing to seek clarification regarding the copyright status and permitted re-use of the information supplied.

I intend to incorporate the data into a searchable database that will enable users to identify whether a vehicle has previously been licensed as a Hackney Carriage or Private Hire Vehicle and to better understand a vehicle’s history and previous use.

The database may be made available commercially and is intended to assist motor traders, businesses, and consumers in identifying relevant vehicle history information. This supports informed decision-making and aligns with industry guidance concerning the disclosure of material vehicle information, including guidance published by Trading Standards and the Advertising Standards Authority (ASA).

Could you please confirm:

1. Whether the information supplied is covered by the Open Government Licence (OGL), either expressly or by council policy.
2. Whether the information may be copied, adapted, published, combined with data from other licensing authorities, and redistributed as part of a commercial vehicle history database.
3. Whether any specific attribution wording is required by the council.
4. Whether there are any restrictions on commercial re-use of the information supplied.

If the information is not available under the Open Government Licence, I would be grateful if you could advise the applicable copyright and re-use terms and whether the council would grant permission for the proposed use.

Response

Thank you for your query about re-use of information published on PHV/Taxi licensing.  Our response to your queries are:  

1. We permit reuse of the published authority data under the OGL. 
2. The information can be copied, adapted, published, combined with data from other licensing authorities, and redistributed in accordance with that licence.
3. We require the standard attribution wording to be used, “Contains public sector information licensed under the Open Government Licence”.
4. There are no restrictions on the commercial use of the information re-used in accordance with the terms of the OGL.
