Contaminated Land
The Council is required to publish a strategy to identify and inspect land within its district for contamination. The strategy details how The Council will take a rational, ordered and efficient approach to identification and remediation of contaminated land.
This is a significant responsibility which extends existing local authority duties under the statutory nuisance regime, planning and development control. The role includes:
- To cause the area to be inspected
- To identify potentially contaminated sites
- To determine whether any particular site is contaminated
- To determine whether any such land should be designated a 'special site'
- To act as enforcing authority for contaminated land not designated as a 'special site'.
Rushcliffe Borough Council's priorities in dealing with contaminated land will be:
- To protect human health
- To protect controlled waters
- To protect designated ecosystems
- To prevent damage to property
- To prevent further land contamination
- To encourage voluntary remediation before taking enforcement action
- To encourage re-use of brownfield sites.
The original strategy was published in 2001, revised in 2010 and again in 2018 to take into account the progress made in the identification and classification of potential contaminated land sites - Contaminated Land Strategy 2018-2023
Register of contaminated land
The Council has a duty to keep a register of all regulatory action taken by the Council in respect of contaminated land. The register can be viewed free of charge at the Civic Centre during normal office hours, or see a Summary of the Register of Contaminated Land.
