Please provide a copy of:

  1. The full, unredacted Radium 226 survey report(s) referred to in:
    • paragraph 1.27 of Vistry Homes Ltd's Matter 5 Hearing Statement (June 2026); and
    • paragraph 6.3 of the Statement of Common Ground dated 25 June 2026 between Rushcliffe Borough Council and the site promoters.
  2. Any associated hotspot map(s) or plans showing the location and extent of Radium 226 contamination referred to in those documents.
  3. Any summary, extract, presentation, briefing note or other document setting out the findings of the Radium 226 survey report(s) referred to in the above paragraphs.

As the Statement of Common Ground was jointly signed by Rushcliffe Borough Council and the site promoters, and refers to additional work undertaken to identify the location of Radium 226 hotspots, I understand that the Council has had access to, or has relied upon, information concerning the survey findings when reaching the conclusions set out in that document.

If any of the requested information is held by the Council but originated from a third party, I would nevertheless request disclosure under the EIR unless a specific exception applies.

Response

We have considered your request under the Environmental Information Regulations 2004 (EIRs) because it is asking for environmental information as defined by Regulation 2(1) of the EIRs.  Regulation 2(1)(b) of the EIR covers factors such as substances, energy, noise, radiation or waste, including radioactive waste, emissions, discharges and other releases into the environment, affecting or likely to affect the elements of the environment.

In accordance with regulation 12(4)(a) I confirm that the information you have requested is not held by the Council at this time. This is because the information referred to has not been submitted to the Council.

Accordingly, the Council will not progress this request further.
