- Tenancy Agreements
- Ensure all new and existing tenancies are periodic (rolling contracts), not fixed-term.
- Remove any clauses allowing ‘no fault’ (Section 21) evictions.
- Evictions
- Only seek to end a tenancy using valid statutory grounds (e.g., rent arrears, anti-social behaviour, selling the property).
- Provide the correct notice period and documentation for any eviction.
- Rent Increases
- Increase rent no more than once per year.
- Provide written notice of any rent increase.
- Ensure rent increases are reasonable and in line with local market rates.
- Property Standards
- Ensure your property meets the Decent Homes Standard and complies with Awaab’s Law (addressing hazards like damp and mould promptly).
- Carry out regular inspections and respond quickly to repair requests.
- Fair Access
- Do not refuse tenants because they have children or receive benefits.
- Remove any “No DSS” or similar restrictions from adverts and policies.
- Pets
- Consider all tenant requests to keep pets fairly and reasonably.
- If refusing, provide a valid reason in writing.
- If accepting, you may require pet insurance to cover potential damage.
- Landlord Registration & Ombudsman
- Register all rental properties with the new national landlord database (when available).
- Be prepared to engage with the new Private Rented Sector Ombudsman for dispute resolution.
- Documentation & Communication
- Provide tenants with all required documents (e.g., How to Rent guide, gas safety certificate, EPC, deposit protection details).
- Keep clear records of all communications, notices, and repairs.
- Enforcement & Complaints
- Cooperate with council or specialist agency investigations into illegal eviction or harassment.
- Respond promptly to any complaints or requests for information from tenants or authorities.
- Stay Informed
- Keep up to date with government guidance and deadlines for implementing new requirements.
- Attend training or seek advice if unsure about your obligations.
