Response

  1. Does your Local Authority have any Article 4 Directions currently in place for HMOs? (C3 to C4).
    • Answer - RBC
  2. If the Local Authority does have an Article 4 Direction (C3 to C4) in place, what kind of designation is it? I.e. Borough/City-Wide, single designated area, multiple single designated areas.
    • Answer - not applicable
  3. Has your Local Authority formally consulted/currently consulting/planning to consult in the next/last 12 months on introducing an Article 4 Direction? (C3 to C4).
    • Answer -

We have not undertaken any formal consultation; we have a request from full council to investigate the effects and impacts of small HMOs created as permitted development and the extent of any such impacts and to feed back on this. Reporting on this question is in its very early stages and no decisions have been taken as to whether evidence suggests an issue exists which would justify action under Article 4, as such no consultation is currently planned. Whilst there are no plans for consultation, this is currently under review as a result of the aforementioned research.

  4. If the Local Authority has formally approved an Article 4 Direction (C3 to C4) in the last 12 months, when does it come into force?
    • Answer - not applicable
  5. What is the best contact email address to contact the planning department to discuss matters relating to planning enquiries and Article 4?
    • Answer -  The manager of our planning enforcement team is likely best placed to offer further feedback, his email address is jbate@rushcliffe.gov.uk
