Information regarding the council’s expenditure on planning appeals relating to residential-led developments.

Please provide the following information for each of the financial years

  1. 2022/23, 
  2. 2023/24, and 
  3. 2024/25:
  1. The total number of appeals lodged against decisions relating to residential-led planning applications, and the total number of residential units involved in these appeals.
  2. The number of appeals that resulted in planning permission being granted, and the total number of residential units approved as a result of such appeals.
  3. The total amount of money spent by the council on legal advice, representation, and any other costs incurred in defending planning appeals.
  4. The total amount paid by the council to appellants in respect of costs awarded against the authority in planning appeal cases.
  5. Of the total expenditure identified in (3), please specify how much related to appeals that were subsequently allowed (i.e. where permission was granted on appeal).
  6. The number of appeals that were made against an officer recommendation for approval?

Response

In relation to questions 1, 2, 6, information is available to view by searching on our Planning Online website  using the advanced search feature and filtering by the dates in your request and searching for appeals. You will be able to locate the proposals, numbers of residential units approved / refused and the dates of when the appeal was submitted and determined and whether the application was reported to planning committee or not.

For the purposes of question 3 we have only included spending as published on the expenditure over £500 reports which is available on our website.

In relation to question 4, the following appeals have had an appeal costs award against the Council from 1 April 2018 to 31 March 2024.

Please look on the aforementioned Planning Online to review the dates of each appeal decision and whether this falls within your dates outlined. The amount of the sum of costs award, where agreed, has been provided against each appeal.
