Request
I am writing to request, under the Freedom of Information Act, an Excel spreadsheet containing details of all contracts due to expire within the next 12 months. Specifically, I would like the spreadsheet to include the following information for each contract:
- Contract reference number
- Contract name
- Start date
- End date
- Any extensions granted
- Contract value
- Winning bidder
- List of all other bidders who participated in the original tender process
Response
We confirm that we hold information in the categories requested.
The information requested in the first seven bullet points in your requests is already publicly available in the published contract register.
The information can also be found by typing ‘contracts register’ into the search box on our website Search - Rushcliffe Borough Council
For this reason, we rely on the exemption at paragraph 21 FOIA ‘Information accessible to the applicant by other means’.
For the last bullet point, which requests information about the unsuccessful bidders, our refusal to provide this information is based on the exemption at paragraph 41 ‘confidentiality’, The reason is that the information held on unsuccessful bidders was provided to us by third parties in the reasonable expectation of confidentiality. This expectation is necessary for tenderers to have confidence in the public contract tendering process. Disclosure of this information could amount to a breach of that expectation of confidentiality.
